Winelands Flooring & Blinds – Terms & Conditions

1. Introduction

Welcome to the winelandsflooring.co.za website (“the Site”). These Terms and Conditions (“the Terms”) govern your (“the Client” / “the User”) use of the Website and all sales and installations provided by Winelands Flooring & Blinds (Pty) Ltd (“the Provider”).

By using the Website or accepting a quotation, you agree to be bound by these Terms.


2. Ownership of Goods

All goods remain the property of Winelands Flooring & Blinds until paid for in full. Ownership passes to the Client only once the funds are reflected in the Provider’s bank account.


3. Payment Terms

  • All materials must be paid in full upon acceptance of a quotation.

  • Ordering of stock commences only once payment has been reflected.

  • A 50% deposit of labour costs is required upon confirmation of the installation date.

  • Final labour balance is due upon completion of installation.

  • Interest of 2.5% will be charged every 48 hours on overdue accounts.


4. Warranties & Claims

  • To process any warranty claim, the following documents are required:

    • Tax invoice

    • Signed Terms & Conditions

    • Signed Client satisfaction sheet (includes product & installation warranty)

  • Warranty claims are subject to inspection by the manufacturer. If no fault is found, the Client will be liable for inspection/call-out costs.

  • Warranties are subject to proper installation, usage, and maintenance guidelines.


5. Cancellations & Refunds

  • Orders cancelled are subject to a 15% handling fee.

  • Custom products such as blinds, shutters, artificial lawn, carpets, and made-to-order items cannot be refunded once manufacturing or cutting has commenced.

  • Installation cancellations must be made at least 48 hours before the scheduled date. A fee of R2,500 will apply if contractors are turned away on arrival.

  • Unused, unopened, uncut, and undamaged products may be returned within 7 days of installation (where permitted by the supplier), subject to a 15% handling fee. Refunds are processed via suppliers and may take up to 14 working days.


6. Assessment & Installation Conditions

  • Quotations are subject to an on-site assessment.

  • Vinyl and laminate quotes require an additional 10–15% allowance for wastage.

  • Subfloor conditions can only be fully assessed once existing flooring is uplifted.

  • Moisture content of subfloors must be below 12% for warranties to apply. Excess moisture must be treated before installation.

  • If uneven subfloors are revealed, screeding will be necessary to honour product warranties. Clients refusing screeding must sign a warranty waiver.

  • The Client must inform installers of any hidden pipes or wiring. The Provider accepts no liability for accidental damage caused to undisclosed services.

  • Furniture moving, door trimming, screeding, tile/parquet removal, or electrical disconnections are not included in standard fitting fees unless specifically quoted.


7. General Conditions

  • The Provider is not responsible for incorrect information or measurements supplied by the Client.

  • Goods cannot be stored by the Provider for longer than 6 months unless agreed in writing.

  • Delivery and installation dates are estimates; delays may occur. The Provider is not liable for consequential costs arising from delays.

  • Breakable/valuable items must be removed by the Client before installation.

  • Peaking of carpet seams, dye batch variations, or minor shade differences do not constitute product or installation faults.

  • Accidental damage during furniture moving or to freshly painted surfaces is not the Provider’s responsibility.

  • If specialised equipment (e.g., dehumidifiers, generators) is required, this will be quoted separately.

  • Complex access requirements (e.g., permits, security clearances, quiet hours) are the Client’s responsibility.


8. Website Use

  • Users may not copy, distribute, or commercially use content from the Website without prior written consent.

  • All content is provided “as is” and the Provider is not liable for errors, omissions, or inaccuracies.

  • Colours displayed online may differ from actual product due to screen variations or dye batches. Samples should be viewed where possible.

  • Comments, feedback, or ideas submitted by Users may be used by the Provider without obligation.


9. Copyright & Intellectual Property

All trade marks, logos, text, graphics, and content on the Website are the intellectual property of Winelands Flooring & Blinds or its suppliers. No use is permitted without prior written consent.


10. Privacy & Data Protection

  • Personal information collected (name, contact details, address, etc.) will be used only to process orders, provide services, and improve the Website.

  • Information will not be shared with third parties except as required by law or to fulfil services (couriers, payment providers, etc.).

  • The Website uses cookies and analytics tools to track performance and provide remarketing services. No sensitive personal information is shared with third parties.

  • Clients have the right to request access, correction, or deletion of personal data in line with POPIA.


11. Jurisdiction & Governing Law

These Terms are governed by the laws of the Republic of South Africa. The Client consents to the jurisdiction of the High Court of South Africa, Western Cape Division, for any disputes.


12. Electronic Communications

By using this Website or communicating electronically with the Provider, you agree that all notices, agreements, and disclosures satisfy legal requirements that such communications be “in writing.”


13. Indemnity

The Client agrees to indemnify and hold harmless the Provider, its employees, and contractors from any claims, damages, or expenses arising from the Client’s breach of these Terms or failure to provide accurate information.


14. Acceptance

By accepting a quotation, placing an order, or using this Website, the Client confirms that they have read, understood, and agreed to these Terms and Conditions.
